Declaration and Revocation 1% Annual Exceedance Probability (AEP) Flood Level

The Goulburn Broken CMA intends to recommence the declaration of 1% AEP flood levels across the Goulburn Broken Catchment. As a pilot, the CMA intends to make a declaration for Nagambie 1% AEP Flood Levels under the requirements of the Water Act 1989. The declaration process includes engagement and consultation with stakeholders and the community. Further, the Goulburn Broken CMA Intends to revoke outdated designated and declared flood levels

Nagambie 1% AEP Flood Levels

Nagambie 1% AEP Flood Levels is available for review by:

  1. Inspecting the flood level plans in person at the Catchment Management Authority Offices located at: 168 Welsford Street Shepparton, 89 Sydney Road Benalla and 5/10 High Street Yea; or
  2. Downloading the pdf map -  Intention to make declaration for Nagambie 1% AEP Flood level declarations; or
  3. Using the interactive online mapping, with a zoom and search function.

The flood level lines (contours) shown within the specified area on this plan defines the surface level of the "1% annual exceedance probability (AEP) flood". This is the flood prescribed by Section 204 Adoption of flood level of the Water Act 1989, for floodplain management purposes and has a 1 in 100 chance of being equalled or exceeded in any one year.

The derivation of these flood level lines has been based on available historical flood information, hydrologic and hydraulic modelling, which includes the combine effect of the 1% AEP flood event and the impacts of climate change.

Areas outside the 1% AEP probability flood limit may be inundated by rarer flood events.

For the purpose of determining flood levels for locations between flood level lines, it can be assumed that the flood surface levels change at a uniform rate between flood level lines.

The flood level lines shown on this plan can be used to assist in the determination of specified levels in accordance with Regulation 153 of the Building Regulations, 2018.

Although there may be buildings within the area covered by the flood level lines, it should not be assumed that the floor of any individual building is below flood level. Buildings should be surveyed to determine whether their floors are above or below the 1% AEP flood level.

Background and intention to revoke designated and declared flood levels

The aim is to make applicable 1% AEP flood level information available to assist stakeholders and the community in land-use planning and building applications. This will also assist local Councils with the report and consent process under the Building Regulations 2018.

Between 2001 to 2007 the Goulburn Broken CMA followed the process of engagement and consultation under Sections 203, 207 of the Water Act 1989 to declare 1% AEP flood levels for various geographic areas. This process will continue and is detailed below under Consultation Process for Declarations by Authorities .

The current designated/declared flood levels are in the links in the below table. Note, many of these flood levels date back as far as 1982 and may no longer be considered relevant in light of new flood information. The Goulburn Broken CMA intends to revoke declared 1% AEP flood as indicated below in the table marked as 'Planned" (see Revoked column). The Consultation Process for Declarations by Authorities section below outlines the requirement to consider any submission within a six-week period. How to make a Submission

The Goulburn Broken CMA is seeking submissions on the intention to make a declaration for Nagambie 1% AEP Flood Levels by 23 April 2026 and is seeking submissions on the intention to revoke declared 1% AEP flood levels marked as 'Planned' in above table by 7 May 2026.

Provide a submission using the following methods:

Aim of the Initiative

The aim of this initiative is to:

  1. Revoke 1% Annual Exceedance Probability (AEP) flood levels that are no longer current and declare new 1% AEP flood levels in areas based on up to date flood studies to ensure that correct information is being utilised by all stakeholders and the community.
  2. Provide statutory consideration for 1% AEP declarations, which complement the flood overlay controls within planning schemes.
  3. Provide access to declared flood levels to assist applicants with planning and building applications.
  4. Streamline statutory processes with local councils through greater certainty.
  5. Declaration of flood levels over specified areas where no flood overlay controls exist in planning schemes to allow consideration for the report and consent process under regulation 153 of the Building Regulations 2018.

A person who is aggrieved by a declaration may apply, within one month after publication of the declaration, to the Minister for review.

 

Section 207 Review of declarations (subsection (2))

“The Minister must notify the applicant of his or her decision on the application.”

Note: Revocation of out-dated declared flood levels will be carried out in the same step as presented above. Those flood levels that were designated under the Drainage of Land Act 1975 will not include intention to revoke as this step was not required in the designation process.
